The Division of Fees Mediation and Arbitration Committee assists in resolving fee disputes between attorneys, primarily in co-counsel arrangements governed by Rule 1.5(f) of the Rules of Professional Conduct. The Committee also hears matters involving disputes between discharged and successor counsel regarding the allocation of contingent fees.
Rather than meeting on a set schedule, committee members are selected on a case-by-case basis to serve as mediators or arbitrators when disputes are formally submitted for review. Through this process, the Committee provides a structured, professional forum for resolving complex fee matters while helping attorneys avoid more formal or adversarial proceedings.
Membership is open to CMBA members in good standing who have experience in mediation or arbitration. This work supports fairness, clarity, and professionalism in financial arrangements within the legal community.
